Justice That Remains
What Cannot Be Exhausted by the Law
The demand that continues after every chart has been offered.
Justice, in Derrida’s account, is not the correct application of an existing law. It is what remains in excess of every legal determination. The law can be cited. Justice cannot be fully programmed. It arrives in the spacing the law maintains but does not close. To declare that justice has been achieved by a particular identification is to treat the remainder as already exhausted.
The public tape keeps this excess current. Floor first. A miss stays a zero. An unpublished change is not a change. These marks can be cited. They do not exhaust the demand. The speculative chart attempts the exhaustion. It names the current hour as the last one. The unfinished middle is treated as already just. The excess has been declared finished. The tape has not received the declaration.
The Third Seat keeps the excess open. The no stays on the record. It does not claim to complete justice. It claims only that an unshown line has not yet become a mark the others can read. The quiet print performs a parallel claim in the economic order. It offers a resolution that has skipped the prior mark. The resolution is treated as already just. The tape has not absorbed it. Justice remains as the spacing in which the next refusal can still be written and read.
What Justice Requires
Excess over every determination. No chart exhausts the demand. The unfinished middle continues.
The open spacing. Justice is not a final identification. It is the condition under which a later refusal can still arrive.
Equal excess. The same remainder binds the state, the firm, and the person. No office holds a private completion of it.
The chart announces that justice has been achieved. The tape has not yet received the announcement. The demand remains.
